These Terms of Service ("Terms") govern your access to and use of Smart Post Studio, including our desktop application, our web application at app.smartpoststudio.com, our website at smartpoststudio.com (including the support chat and AI demonstration features), and any related services (collectively, the "Service"). The Service is operated by Smart Post Studio LLC, Atlanta, Georgia, USA ("we", "us", "our").
By using the Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using Smart Post Studio on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to:
Subscription — Smart Post Studio is offered as a subscription. Your subscription gives you access to the latest version of the software and all updates for as long as your subscription is active.
This licence does not include the right to sublicense, resell, or distribute the software.
To use Smart Post Studio, you must create an account with a valid email address and password. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or are found to be fraudulent.
Smart Post Studio is designed for legitimate social media management. Permitted uses include:
Violations of these restrictions may result in immediate account termination and may expose you to legal liability. You may not use Smart Post Studio to:
Smart Post Studio includes AI-powered features (the AI Writing Studio, the Sol help chat, and the website caption demonstration), powered by third-party large language models.
Smart Post Studio connects to third-party social media platforms. You are solely responsible for ensuring your use of the application complies with the terms of service of each platform you connect, including:
Smart Post Studio is not affiliated with, endorsed by, or sponsored by any social media platform. Platform APIs and access may change or be revoked at any time by the platform, which may affect functionality.
Pricing — Smart Post Studio is available as a monthly subscription at $19/month, quarterly at $15/month ($45 billed every 3 months), or semi-annually at $11/month ($68 billed every 6 months). Prices are displayed in USD and may vary by region.
Free trial — all new users receive a 14-day free trial. No payment method is required to start a trial, and no charge is made unless you purchase a plan.
Automatic renewal — subscriptions renew automatically at the end of each billing period until cancelled. Payments are processed by Gumroad and subject to their payment terms; we do not store your payment information. Purchases made through an app store (such as the Microsoft Store) are billed and renewed under that store's terms.
Cancellation — you may cancel your subscription at any time. Access continues until the end of your current billing period.
30-day money-back guarantee — if Smart Post Studio doesn't work for you within 30 days of your first paid subscription charge, email support@smartpoststudio.com and we will refund that charge. No questions, no hoop-jumping.
AI top-up credits — purchases of additional AI generation credits are one-time consumable purchases and are non-refundable, except where a refund is required by applicable law. This is disclosed at the point of purchase.
Abuse — where account usage is inconsistent with normal single-user operation (for example, automated or extraordinary volumes of AI generation), we may deduct our direct third-party costs from any refund, or decline a refund as abuse of the guarantee.
Smart Post Studio operates an affiliate program (see smartpoststudio.com/partners). Affiliate commissions accrue on qualifying referred purchases, are subject to a holding period, and are reversed where the referred purchase is refunded, disputed, or found to be fraudulent. Participation is subject to approval, and we may suspend affiliates who violate these Terms or misrepresent the product.
Smart Post Studio, including its code, design, graphics, and branding, is owned by us and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
Your content — you retain full ownership of all content you create, draft, generate, and publish using Smart Post Studio, including AI-assisted content. We claim no rights over your posts, images, or other content.
You grant us a limited licence to process and transmit your content solely to the extent necessary to provide the Service — for example, briefly relaying a media file through our infrastructure when a social platform's API requires the file to be retrieved from a public URL. Such relayed files are automatically deleted, as described in our Privacy Policy.
Smart Post Studio is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that scheduled posts will always publish successfully. Social platform API changes, network issues, or platform outages may affect posting reliability. Because the desktop application publishes from your computer, scheduled posts made in the desktop app require the application to be running at the scheduled time. The web application is currently offered as a beta; features may change, and cloud-scheduled publishing may be interrupted by maintenance or infrastructure outages.
Any benefits offered to waitlist members or as promotions — such as free periods, discount codes, or early access to new features — are offered at our sole discretion and may be modified, withdrawn, or substituted at any time without notice and without creating any liability or obligation on our part. Features described as planned or "coming soon" are not guaranteed to be delivered, and no purchasing decision should rely on them.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use Smart Post Studio.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid for Smart Post Studio in the 12 months preceding the claim. For users who have not paid any amount (including waitlist members and free trial users), our total liability shall be zero.
You may stop using Smart Post Studio at any time by deleting the application and your account.
We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or use the Service in a way that harms other users or third parties.
Upon termination, your licence to use the software ends. Sections on intellectual property, disclaimers, and limitations of liability survive termination.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be brought in the state or federal courts located in Georgia, USA, and you consent to their jurisdiction. Nothing in this section limits any mandatory consumer rights you hold in your country of residence.
